ORDERING
FROM THE WEBSITE: We
use PayPal to process all credit card orders from our website.
Buyers do not need a PayPal account to purchase with a
credit card from our website. PayPal uses higher
security processing, so when ordering from our website,
you will be asked to provide the billing address of the
credit card you are using.
Telephone
Orders: If
you want your order shipped to a different address than
your credit card billing address, or you just prefer to
order over the telephone, you should call and order from
our toll-free order number. We can ship your items to the address you prefer
to have them shipped too. Call 866-452-4563 to
order over the phone.

RETURNS
We
are not responsible for damage done by the carrier
during transit.
DO NOT ACCEPT ITEMS THAT HAVE RECEIVED
SHIPPING DAMAGE. (If it's just a paint touch-up that is
needed, the Manufacturer will send touch-up paint, so
don't refuse an item because of cosmetic issues) If you
do accept damaged goods, it
is the responsibility of the customer to report any
damaged equipment they accepted to the freight carrier
immediately. Note the damage on the "Bill of
Lading" this is important. Please be aware that
freight carriers have
very strict requirements on equipment damaged in
transit. If
you suspect a product you received is damaged and you
accept it anyway, make note
of the damage on the delivery slip (Bill of Lading) from the
carrier when you sign for the delivery, the Driver
should sign the slip as well.
Manufacturers do not consider shipping damage as a
Warranty item, so you must report damaged items you accepted to the freight carrier
within 7 days to make a claim, but the sooner the better.
It is the
responsibility of the Buyer to report this to the
Carrier so they can reimburse you directly for damaged goods or correct the
problem themselves.
Delivery of
purchased items will be
considered "Complete" at the time of shipment from
Smitty's Equipment Sales warehouse locations. Ownership will pass to Purchaser at
the time of pick-up by the Delivery Carrier from our
warehouse.
Tracking or PRO numbers will be provided upon request so
you can track your property during it's shipping
process.
If
you don't receive it within a reasonable time frame, you
should call Smitty's and we will call the shipping company
with the tracking number and find out what the delay
is.
We
can help you by providing you the tracking numbers, PRO
numbers and the Shippers phone number, but please don't
be angry with us if the Shipper isn't fast enough.
LOST
SHIPMENTS: All UPS shipments are insured by
Smitty's for the replacement amount. When UPS
deems that a shipment is actually lost and a credit is issued any
lost items by UPS will be replaced at no charge to the
Customer. Please be patient while this process is
accomplished. Of the thousands of shipments made
in the last 8 to 10 years, UPS has only really
"lost" three of them, so there is an extremely
slim chance a shipment from Smitty's warehouse won't
reach it's destination within a reasonable amount of
time, and be located with it's tracking number UPS
provides.
SHIPPING

specially made items.

cannot guarantee that orders being " drop-shipped" from
a manufacturer's warehouse or shipped from our warehouses will arrive by a certain
day or time.
Regarding
Drop-Shipped orders: Smitty's has
no control over any Manufacturer's shipping procedures,
truck load scheduling, loading procedures, Truck
Driver's
driving speed or possible delays caused by snowstorms,
tornados, floods or any other adverse weather or
hazardous conditions Truck Drivers may encounter while
hauling your order.
"Free
Shipping" or Orders marked "Delivered":
Orders under
150 lbs. will ship "UPS Ground". If you
want your UPS Ground shipped order processed for
"over-night shipping" or shipped quicker than
the free ground shipping on some orders may provide, you
can upgrade your order by paying for a quicker method of
shipping.
Orders
that you prefer to ship special delivery: For instance,
UPS Next Day Air, UPS Next Day Air Saver,
UPS 2nd Day Air or UPS Three-Day Select must be
processed at the time the order is being placed. Call
630-678-9010 to get a shipping quote and to place your
order at the same time. You will be given the date and
approximate time that UPS gives for your delivery.
A tracking number can be provided as well.
NOTE:
Vehicle Lifts, Air Compressors, Tire Machines and other
larger heavier items always ship "Truck
Freight" by a common carrier.
Parts
Returns:
We
claim no responsibility for any incorrect
repair diagnosis or misinformation by others or wrong or unneeded parts being ordered by
anyone, unless
we specifically made a order error ourselves and sent you a
part that is not listed on your sales receipt.
Custom
made
parts or specially ordered parts (that Customer
provided
a
specific part number we normally don't stock) or a part we have
to acquire, have made, or specially
ordered obsolete
parts are
non-returnable.
So make sure you really want them before
ordering these kind of parts. You will be informed at
time of quote whether the part has to be made or not.
Before
returning any product, you must call 630-678-9010 for a
return authorization number. Refunds will be
processed for any parts returned within 15 days from purchase,
freight prepaid by Purchaser. (So
please don't wait a month or more to call and ask to return a
product or part.)
Returns
sent back without prior call will be charged a 50%
repackaging, restocking fee, so call before sending something
back please.
The customer is responsible for any
return freight costs. We do not accept collect or C.O.D.
shipments. A
Restocking fee of 25% will be charged for any
returned items that were marked "free-delivery" or "Delivered"
when they were
purchased. Free shipping
was paid for by Smitty's and refunds on shipments will recover part
of the expense incurred to deliver the items since the
sale is being cancelled. Restocking fees of 15% to 20% on other
items without initial free delivery.
Custom made parts or specially ordered parts and
equipment are not
returnable.
All
returns must be unused and in the original packaging and
have the manufacturers paperwork, including owner’s
manual.
A
refund will be given after the product has been inspected for damage.
CANCELING ORDERS BEFORE THEY ARE SHIPPED OUT.
(NOTE:
This pertains to "Over the Phone Purchases or
Mailed in Check Orders
Only" not direct website purchases) The
credit card processing company we use for phone based purchases,
does not refund their processing
fees when we refund money for a purchase someone wishes
to cancel. Therefore, any orders over $100.00 that are
canceled by the Buyer before shipment of the product,
the 3.4% credit card processing
fee we were charged will be deducted from the refunded
purchase amount. We can not be responsible for
paying the processing fee for cancelled orders. So before ordering anything
over the phone, please make sure you are not going to want to cancel the
order. That way you can avoid being charged the credit
card processing fees that were charged and are not
refundable. (Example
sale: $1000.00 = $34.00 processing fee we get charged
that is not refunded when we give someone a refund for canceling
their order before shipment.) This does not pertain to
website based credit card or PayPal purchases processed
by PayPal. You will receive a 100% refund when canceling
an order that hasn't been shipped yet if you bought it directly
from our website. (Unless it's a specially made
item.)
PayPal does not keep the processing
fee it charges if you want a refund.
Orders
paid by check on equipment that must be built to order
and not in stock.
Will be charged a 5% to
25%
cancellation fee, depending on what our Vendor charges us
to cancel a specially built item that is already in
production that they do not
stock. So,
please make sure you want something built before you
order it, because items that have to be specially built
have a cancellation fee if you decide to cancel it after
it's already being made.
TAXES
Prices
shown do not include any applicable sales taxes.
Illinois Sales Tax will be added automatically to orders
from Customers in the State of Illinois. Customers
outside of Illinois are responsible for paying any taxes
owed to the State, County, Parish or Municipality in which
they reside. All
shipments made within the State of Illinois will be
charged 8.25% sales tax.
Rotary
Lifts charges sales tax on all orders being drop-shipped
from Rotary's Location to all States but OK, AL, NH
& DE. Sales Tax on Rotary Lifts will be applied
except for the four States listed. BendPak
Lifts charges sales tax on any drop-shipped products
into California. Challenger Lift charges sales tax on
drop-shipped items into Kentucky.
There are other Manufacturers that have
similar tax policies as well on drop-shipments.
"DELIVERED"
Means...
"DELIVERED"
on this website means "NO DELIVERY FEE" for deliveries
to locations in the contiguous 48 States.
Purchases going to Alaska, Hawaii, Canada or anywhere
else, will include
a shipping fee.
Please call for shipping quote to these
locations, your ZIP code will be needed.
Repair
parts usually ship within 24 hours unless it's a
backordered part.
Most
other equipment (i.e. lifts, compressors, tire
machines, etc.) usually ship within 7 to 14 business days. All shipping and
transit times are estimates, and determined by the
freight carriers. Delivery of items will be
considered "Complete" at time of shipment from
Smitty's locations. Ownership will pass to Purchaser at
time of pick-up by Carrier from our location.

Some larger items, such as vehicle
lifts, will require a forklift or other means for
unloading at the Buyers location. Unloading
the truck is strictly the responsibility of the Buyer.
Trucking Companies call before delivering the equipment
and that is the time to coordinate your unloading
schedule with the driver that has the bill of lading
with him. That way you know exactly what he has that you
will be unloading and when.
In some cases, it is recommended that the buyer pick up
the product from the carrier’s freight dock or some
other nearby location they choose if means to unload a
semi-truck at the point of use is not available.
Most local Truck Terminals can also provide alternative
delivery methods at reasonable costs if you want
lift-gate service or a smaller truck to do the last
stage of delivery.
LIMITS
OF LIABILITY
Seller
provides no warranties other than in accordance with the
Manufacturer's written limited warranty accompanying the
particular product sold. In no event shall Seller be liable for special,
consequential, or incidental damages or injures of any
kind or nature whatever, including but not limited to loss of profit, rental of
substitute equipment or other commercial loss, for the breach
of or delay in performance of the Manufacturer's Warranty.
In no event will
Seller's liability exceed the original price paid for the product.
We
claim no responsibility for any incorrect
repair diagnosis or misinformation by others or wrong or unneeded parts being ordered by
anyone, unless
we specifically made an error ourselves and sent you the
wrong part other than the part you asked for.
Prices
on our website may be updated at any time. We do not guarantee today's
prices to be the same as tomorrows unless a current sale
has an expiration date or you get a quote from our
office. We reserve the right to cancel any order that
may have an extreme pricing error or technical pricing
error in the button code on the website.
Please
"refresh" the web page to see the most current
pricing information.
Occasionally
prices may change, but computer browsers don't always
"refresh" the page when you open the page
unless you have them set to do so. To avoid purchasing
something and paying an "old price" by
mistake, please refresh the page in your browser to
insure your order doesn't get cancelled due to the price
being out of date.
If
you buy something from a non-refreshed page and the
price is different than the new price, we will refund
your money immediately. However,
if the price was lowered and you paid a higher price do
to buying from an non-refreshed page, we will issue you
a refund of the amount you would have gotten in savings
at the lower cost plus ship your item to you
promptly.
WARRANTIES
All
equipment ships with the Manufacturer’s full warranty. The
Manufacturers of the equipment sold on this site provide
warranties to the end user. No express or implied
warranties, with the exception of those given by the
manufacturer, are claimed or recognized by Smitty's
Equipment Sales. We will assist the purchaser in any
issues regarding warranty for products purchased through
our site, but the manufacturer must make the final
determination of warranty.
Warranty items should be shipped directly to the
Manufacturer or warehouse from where it originated for
faster service.
Any
litigation, claims or disputes brought against Smitty's
Equipment Sales, must be made in the State of Illinois,
County of DuPage. By purchasing a product from this
site, or directly from Smitty's Equipment Sales, Division
of Blizzard Wizzard's Snowplowing Incorporated, you are agreeing to abide by these terms and
conditions.
SECURITY
AND CONFIDENTIALITY
Smitty's
Equipment Sales agrees to hold all information from the
purchaser in the strictest confidence. No private
information (name, address, phone number, customer I.D.,
etc.) shall be shared with any other entity, other than
for shipping the requested product or to conduct
business with said customer.
Smitty's
Equipment Sales does not store credit card information
resulting from purchases made by telephone. Our website uses
"Paypal" to process credit cards from website purchases,
and at no time will your data be shared with outside
sources, in fact, Paypal does not share your credit card
information with Smitty's either.
Paypal processing is possibly the safest way to
make a purchase from a website.
